Welcome to Top Gear Solutions ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website, products, and services. By accessing or purchasing from our website, you agree to be bound by these Terms. If you do not agree, please do not use our services. We may update these Terms at any time, and continued use constitutes acceptance of the revised Terms. Please review these Terms regularly.

1. Shipping Policy

We strive to provide fast and reliable shipping:

  • Standard Shipping: Most items ship within 1-2 business days.

  • Guaranteed In Stock Items: These ship the next business day.

  • Direct Ship/Drop Ship Orders: May take up to 10 business days to ship. Cancellation fees may apply.

  • Time-Sensitive Orders: Contact us before ordering to confirm feasibility.

  • No Backorders/Pre-Orders: We do not process these without prior agreement. If an order cannot ship within 3-5 business days, we will contact you for approval.

2. Real-Time Tracking

We provide tracking updates via email at the address provided during checkout. Our automated system updates tracking at the end of each business day, including estimated delivery dates.

3. Shipping Carriers and Distribution

We use a nationwide distribution network to ship from the nearest facility to your destination, minimizing costs and delivery times. Orders may ship via USPS, FedEx, DHL, UPS, or other carriers for large freight items. Some orders may ship directly from the manufacturer.

4. Price Matching

We offer price matching for identical items (same part number/options) from authorized dealers:

  • Requirements: Provide a link to the competitor’s listing and a screenshot of the item in your cart, including shipping costs.

  • Store Credit: Successful price matches may include up to $25 store credit for your next purchase.

  • Exclusions: We reserve the right to refuse price matching due to outdated pricing, typographical errors, or other reasons.

5. Damaged or Missing Items

Inspect all packages upon delivery. Report damages or missing items on the day of receipt by contacting us. Failure to report promptly may limit remedies.

6. Fitment Issues

If an item does not fit properly, contact us immediately. We may refer you to the manufacturer for troubleshooting, as they are often best equipped to assist.

7. Warranty Claims

All products are sold "as is." Warranty claims are handled by the manufacturer. Contact us for guidance on submitting claims, and refer to the manufacturer’s warranty guidelines for eligibility and terms.

8. Vehicle Fitment and Item Descriptions

We strive to ensure accurate item descriptions and titles. However, descriptions may be generic. Verify compatibility with your vehicle before purchasing, and contact us with any questions.

9. Returns and Exchanges

We offer a 30-day return and free exchange policy, subject to the following:

  • Eligibility: Items must be brand new, uninstalled, and in original packaging.

  • Return Process: Obtain a Return Merchandise Authorization (RMA) number and specific return address from us. Write the RMA number on the box or include the RMA form as instructed.

  • Non-Returnable Items: Electronic tunes (e.g., JB4, BM3, Cobb AP, JB+, ETC), electronics, wheel packages, special/custom/built-to-order items, turbo kits, large freight (e.g., carbon fiber parts), exhaust systems, or discontinued items cannot be returned. Used or damaged items are also non-returnable.

  • Restocking Fee: Returns without exchange incur a 25% restocking fee.

  • Shipping Costs: Shipping charges are non-refundable. For "free shipping" orders, actual shipping costs will be deducted from refunds.

  • Return to Sender: Packages marked "Return to Sender" will not be refunded, as they do not reach our return facility.

  • Exchange Policy: Exchanges for similar items incur no restocking fee and must be initiated within 30 days of purchase.

  • Tracking: Use a carrier with tracking and provide us with tracking information.

10. Refund Processing

Refunds are processed within one week of return receipt, subject to bank processing times.

11. Order Cancellation

  • Store Credit: Cancellations receive 100% store credit.

  • Refunds: Cancellation refunds incur a fee of up to 7% to cover transaction and fraud service costs. Special/custom/built-to-order items (e.g., turbo kits) may incur up to a 20% cancellation fee.

12. Payment Processing

All orders are billed in full at checkout. We do not accept American Express (AMEX).

13. Right to Cancel or Refuse Orders

We reserve the right to cancel or refuse orders for reasons including, but not limited to:

  • Discontinued or unavailable items

  • Unverified payment or shipping address

  • Pricing or product description errors

  • Fraud risk

  • Mismatched billing and shipping addresses

  • Incorrect or missing options

  • High risk of shipping loss

14. Taxes

New Jersey sales tax applies to orders shipped to NJ residents. Sales taxes may apply in other states as required by law.

15. California Emissions Compliance

We comply with California regulations and cannot ship non-CARB-exempt items or products that tamper with emissions to California. Such orders will be automatically refunded and canceled. Race-only products are for off-road use only and must not be used on public roadways.

16. Emissions Tampering

By purchasing, you agree that any products altering emissions controls are for off-road or race use only, in compliance with applicable laws. We are not liable for misuse.

17. Race-Only Products

Unless stated otherwise, all products are designated for race-only use in sanctioned competitions. Use on public roads may violate local, state, or federal laws, and you assume full responsibility for compliance.

18. Coding Services

Coding services are provided "as is" with no warranty, express or implied. Purchases are final, non-refundable, and non-transferable. We are not liable for any damages arising from coding services and reserve the right to refuse, cancel, or terminate agreements without notice.

19. Intellectual Property

All website content (text, images, logos) is owned by Top Gear Solutions and protected by copyright. You may not reproduce or distribute without permission. User-submitted content (e.g., reviews) grants us a non-exclusive license to use, and we may remove violating content.

20. Limitation of Liability

To the fullest extent permitted by law, Top Gear Solutions is not liable for indirect, incidental, or consequential damages (e.g., lost profits) arising from your use of our website, products, or services. Our total liability shall not exceed the amount you paid us in the prior 12 months.

21. Governing Law and Dispute Resolution

These Terms are governed by the laws of New Jersey, USA. Disputes will be resolved through binding arbitration in New Jersey, except where prohibited by law. You waive the right to participate in class actions.
